Terms of Service

General / scope


The following general terms and conditions (hereinafter referred to as "GTC") apply to all services offered by PL-Saunabetriebs GmbH Metropol-Sauna, (hereinafter referred to as "Metropol-Sauna") in the Frankfurt and Essen facilities and by the visitor (hereinafter "visitor "Called) are accepted. Furthermore, the terms and conditions apply to all other contractual and contract-like relationships that exist between the Metropol-Sauna and the visitor. When using the services offered by the Metropol Sauna, these terms and conditions are deemed to be binding, unless otherwise agreed in writing with the managing director or are required by law. Any other terms and conditions are hereby contradicted - subject to prior express written approval by the Metropol-Sauna.

Compliance with the conditions


The visitor is entitled to use the services of the Metropol Sauna to the agreed extent from the conclusion of the contract. The visitor undertakes to comply with the rules of the house and use posted in the sauna as well as the instructions of the service staff. Bonus cards personally issued by the Metropol-Sauna are not transferable, any transfer (especially the sale) is prohibited without the written consent of the Metropol-Sauna.

The Metropol-Sauna is entitled to change the opening times at any time. All prices can be recalculated and adjusted by the Metropol Sauna at any time. The automatically generated translation into various languages ​​on the website (www.Metropol-Sauna de and sub-pages) provides non-binding information for the guest. Despite taking the greatest possible care, the provider cannot accept any liability or guarantee for the correctness of the translation or its completeness.

Health, use of fitness equipment and sauna at your own risk


The visitor is fully responsible for his own health. The visitor assures that they have no knowledge of health or physical restrictions and / or that they are not taking medication that speaks against the use of the sauna facilities or fitness equipment. Acting against their better judgment and other self-damaging behavior are at the expense of the visitor. Use of the sauna facilities and fitness equipment in the Metropol sauna is voluntary and at your own risk.

The Metropol-Sauna reserves the right to claim damages in the event of misconduct by the visitor. This applies, for example, to misuse of the Internet stations (use or download of illegal content, behavior relevant to criminal law, etc.) or damage to the premises of the Metropol sauna or its objects of use and furnishings.


In the event of damage, loss or gross soiling of the following items, compensation must be paid in the amount of: EUR 12 per pair of bathing shoes; EUR 6 per towel; EUR 20 per key and / or lock; EUR 45 per multi-gym pin; EUR 20 per key of the treadmill; EUR 50 per transmitter. For coarse soiling of other objects or the premises of the Metropol sauna, the responsible visitor has to pay compensation of EUR 30.00.

For false alarms of the automatic fire alarm system triggered by gross negligence (in particular smoking tobacco products outside of the permitted areas), we demand compensation of at least EUR 750 for the use of the fire brigade, possible checking of the detector and loss of income due to operational disruptions.


The Metropol-Sauna reserves the right to claim further damages. The visitor is free to prove that the damage was lower.

privacy


Note according to § 33 BDSG: The name and address of the visitor as well as other required data are stored in automated files for cashless payments. The data will not be passed on to third parties unrelated to the use of the sauna / contract processing without the express consent of the authorized persons.

Video surveillance


We would like to point out that the premises of the Metropol sauna (especially lockers, cash desk area, whirlpool, bar, entrances) are video-monitored. Recordings are - to the extent and as long as this is necessary in individual cases for the safety of our guests and for the investigation of criminal offenses - only left on request to the investigative authorities. The recordings are treated confidentially, are technically secured and are not made accessible to visitors or staff. All video data will be deleted after 10 days at the latest. The relevant provisions of the Federal Data Protection Act are observed

Limitation of Liability


Metropol-Sauna or its vicarious agents are only liable for damage in connection with this contract, regardless of the legal basis, in the event of willful intent or gross negligence. The exclusion of liability applies in particular to unforeseeable events, political influences, war and natural disasters. The limitation of liability does not apply to statutory liability for damage resulting from injury to life, limb or health. The amount of the compensation is limited to the amount of the price of the mediated service. No liability is assumed for clothing or other items brought along, in particular valuables and money. The limitation of liability only applies insofar as nothing else is stipulated by law. Liability for more remote consequential damage or indirect damage is also excluded in the event of negligence.

Other provisions


For all disputes between the visitor and Metropol-Sauna, regardless of the legal reason, the agreed place of jurisdiction is Frankfurt aM, provided that the visitor is a merchant within the meaning of the Commercial Code, the visitor has no general place of jurisdiction in the Federal Republic of Germany or after Conclusion of the contract moves his place of residence or usual place of residence out of the area of ​​application of the civil procedure code or this is not known at the time the action is brought.

German law applies exclusively to all disputes between the visitor and the Metropol-Sauna. The entrepreneur does not undertake to participate in dispute settlement proceedings before a consumer arbitration board.


Should individual provisions of these terms and conditions be or become ineffective, the remaining conditions shall remain in effect.
