Allgemeine Geschäftsbedingungen Allgemeines/ Geltungsbereich Die nachstehenden allgemeinen Geschäftsbedingungen (nachfolgend „AGB“ genannt) gelten für sämtliche Leistungen, die von der PL-Saunabetriebs GmbH Metropol-Sauna, (nachfolgend „Metropol-Sauna“ genannt) in den Betriebsstätten Frankfurt und Essen angeboten und vom Besucher (nachfolgend „Besucher“ genannt) angenommen werden. Ferner gelten die AGB für alle sonstigen vertraglichen und vertragsähnlichen Beziehungen, die zwischen der Metropol-Sauna und dem Besucher bestehen. Bei Nutzung des Leistungsangebotes der Metropol-Sauna gelten diese AGB als verbindlich vereinbart, soweit nicht etwas anderes schriftlich mit dem Geschäftsführer festgelegt wurde oder gesetzlich zwingend vorgeschrieben ist. Anders lautenden Geschäftsbedingungen wird – vorbehaltlich einer vorherigen ausdrücklichen schriftlichen Anerkennung durch die Metropol-Sauna – hiermit widersprochen. Einhaltung der Bedingungen Der Besucher ist zur Nutzung der Leistungen der Metropol-Sauna im vereinbarten Umfang ab Vertragschluss berechtigt. Der Besucher verpflichtet sich, die Vorschriften der in der Sauna ausgehängten Haus- und Benutzungsordnung sowie die Anweisungen des Servicepersonals einzuhalten. Persönlich von der Metropol-Sauna ausgehändigte Bonuskarten sind nicht übertragbar, jede Weitergabe (insbesondere der Verkauf) ist ohne schriftliche Genehmigung der Metropol-Sauna untersagt. Öffnungszeiten Die Metropol-Sauna ist berechtigt, die Öffnungszeiten jederzeit zu ändern. Sämtliche Preise können von der Metropol-Sauna jederzeit neu berechnet und angepasst werden. Die im Internetangebot (www.Metropol-Sauna de und Unterseiten) dargestellte automatisch erzeugte Übersetzung in verschiedene Sprachen stellt eine unverbindliche Information zur für den Gast zur Verfügung. Für die Richtigkeit der Übersetzung und deren Vollständigkeit kann der Anbieter - trotz Waltung von größtmöglicher Sorgfalt - keine Gewähr und Haftung übernehmen. Gesundheit, Nutzung Fittnessgeräte und Sauna auf eigene Gefahr Der Besucher ist für seinen Gesundheitszustand in vollem Umfang selbst verantwortlich. Der Besucher versichert, keine Kenntnisse von gesundheitlichen oder körperlichen Einschränkungen zu haben und/oder Arzneimittelmittel zu nehmen, welche gegen eine Nutzung der Saunaeinrichtungen oder der Fitnessgeräte sprechen. Handeln wider besseres Wissen und sonstiges selbstschädigendes Verhalten gehen zu Lasten des Besuchers. Die Nutzung der Saunaeinrichtungen und der Fitnessgeräte der Metropol-Sauna erfolgen freiwillig und auf eigene Gefahr. Schadensersatz Die Metropol-Sauna behält sich das Recht des Schadensersatzes bei Fehlverhalten des Besuchers vor. Dies gilt bspw. bei Missbrauch der Internetstationen (Nutzung oder Download von illegalen Inhalten, strafrechtlich relevantes Verhalten etc.) oder der Beschädigung vom Räumlichkeiten der Metropol-Sauna oder deren Nutzungs- und Einrichtungsgegenständen. Bei Beschädigung, Verlust oder grober Verschmutzung der folgenden Gegenstände ist Schadensersatz zu leisten in Höhe von: EUR 12,- je Paar Badeschuhe; EUR 6,- pro Handtuch; EUR 20,- pro Schlüssel und/oder Schloß; EUR 45,- pro Pin der Kraftstation; EUR 20,- pro Key des Laufbandes; EUR 50,- pro Transmitter. Für grobe Verschmutzungen von sonstigen Sachen oder den Räumlichkeiten der Metropol-Sauna ist vom verantwortlichen Besucher ein Schadensersatz von EUR 30,- zu leisten. Für durch grobe Fahrlässigkeit ausgelöste Fehlalarme der automatischen Brandmeldeanlage (insb. das Rauchen von Tabakprodukten außerhalb der zugelassenen Bereiche) verlangen wir Schadensersatz in Höhe von mindestens EUR 750,- für den Einsatz der Feuerwehr, evtl. Überprüfung des Melders sowie Einnahmeausfall wegen Störung des Betriebs. Die Metropol-Sauna behält sich das Recht vor, weiteren Schadensersatz geltend zu machen. Dem Besucher steht es frei, einen geringeren Schaden nachzuweisen. Datenschutz Hinweis gemäß § 33 BDSG: Name und Anschrift des Besuchers sowie sonstige erforderlichen Daten werden bei bargeldloser Zahlung in automatisierten Dateien gespeichert. Die Daten werden nicht ohne ausdrückliche Zustimmung der Berechtigten an Dritte, die in keiner Verbindung zu der Saunanutzung/Vertragsabwicklung stehen, weitergegeben. Videoüberwachung Wir weisen darauf hin, dass die Räumlichkeiten der Metropol-Sauna (insb. Spinde, Kassenbereich, Whirlpool, Bar, Eingänge) videoüberwacht werden. Aufzeichnungen werden - soweit und solange dies im Einzelfall zur Sicherheit unserer Gäste und zur Aufklärung von Straftaten erforderlich ist - ausschließlich auf Verlangen den Ermittlungsbehörden überlassen. Die Aufzeichnungen werden vertraulich behandelt, sind technisch gesichert und werden weder Besuchern noch Personal zugänglich gemacht. Die Löschung aller Video-Daten erfolgt nach spätestens 10 Tagen. Die einschlägigen Bestimmungen des Bundesdatenschutzgesetzes werden eingehalten Haftungsbeschränkung Für Schäden im Zusammenhang mit diesem Vertrag, gleich aus welchem Rechtsgrund, haftet die Metropol-Sauna oder ihre Erfüllungsgehilfen nur bei Vorsatz oder grober Fahrlässigkeit. Der Haftungsausschluss gilt insbesondere für unvorhersehbare Ereignisse, politische Einflüsse, Krieg und Naturkatastrophen. Die Haftungsbeschränkung gilt nicht für die gesetzliche Haftung für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit. Die Höhe des Schadensersatzes ist beschränkt auf die Höhe des Preises der vermittelten Leistung. Für mitgebrachte Kleidung und sonstige Gegenstände, insbesondere Wertgegenstände und Geld, wird keine Haftung übernommen. Die Haftungsbeschränkung gilt nur insoweit gesetzlich nichts anderes vorgeschrieben ist. Auch die Haftung für entferntere Folgeschäden oder mittelbare Schäden ist bei Fahrlässigkeit ausgeschlossen. Sonstige Bestimmungen Für alle Streitigkeiten zwischen dem Besucher und Metropol-Sauna, gleich aus welchem Rechtsgrund, wird als Gerichtsstand Frankfurt a.M. vereinbart, sofern es sich bei dem Besucher um einen Kaufmann im Sinne des Handelsgesetzbuches handelt, der Besucher keinen allgemeinen Gerichtsstand in der Bundesrepublik Deutschland hat oder nach Vertragsschluss seinen Wohnsitz bzw. gewöhnlichen Aufenthaltsort aus dem Geltungsbereich der Zivilprozessordnung verlegt oder dieser im Zeitpunkt der Klageerhebung nicht bekannt ist. Für sämtliche Streitigkeiten zwischen dem Besucher und Metropol-Sauna gilt ausschließlich deutsches Recht. Der Unternehmer verpflichtet sich nicht, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen.
